Scott’s Profile

Scott is an Associate in the firm’s Insurance and Financial Services Litigation Practice in the Birmingham office. His practice focuses on complex financial services litigation.

Prior to Maynard Cooper, Scott’s practice involved defending design professionals and contractors in complex construction and environmental disputes throughout the Southeast United States. Scott also clerked for Judges L. Scott Coogler, Abdul K. Kallon, and C. Lynwood Smith of the United States District Court for the Northern District of Alabama. This broad practice and understanding of the federal district courts gained during his time clerking allows Scott to effectively represent clients in complex federal litigation.

Scott earned his J.D. summa cum laude from the University of Alabama School of Law, where he was a Dean M. Leigh Harrison Scholar, Hugo L. Black Scholar, and a member of the Alabama Law Review and the Bench and Bar Legal Honor Society.  While at Alabama, Scott was named to the Order of the Coif and received the Federal Bar Association Award and the Lanier Ford Shaver & Payne Award.  Scott received his B.S. and M.S. in Civil Engineering from the University of Alabama.

Scott’s Experience

  • Defended a prime contractor in a case involving an injury to another contractor’s employee. The case was successfully resolved after demonstrating the employee’s injuries were the result of a chronic respiratory condition that pre-existed the alleged incident.
  • Defended an engineer in a complex litigation case in which the plaintiff alleged the engineer’s defective reports led to a damages to a large, municipal construction project. The case was successfully resolved after demonstrating the exploration met the industry standard of care and the damages sought were subject to an enforceable limit of liability.
  • Defended an engineer in claims arising from an allegedly defective inspection report. The case was resolved after arguing the alleged defects were outside the scope of the inspection or were the result of conditions that occurred after the inspection.
  • Defended an engineer in a case in which the contractor sought indemnification from the engineer, alleging the engineer’s design was defective. The case was resolved after successfully arguing the design was adequate per the engineer’s contract with the owner and the applicable building and safety codes, and no indemnification was owed to the contractor.
  • Defended an engineer in claims in which property owners alleged the engineer’s design of a stormwater sewer system was defective.  The case was settled after successfully arguing the engineer’s design met all applicable subdivision regulations, and the property owners’ issues were related to construction defects rather than design defects.
  • Defended an international consulting firm in a case involving environmental due diligence services performed by firm. The due diligence services involved an assessment of all permits required under state or federal law. The EPA and ADEM argued the owner required additional permits related to wastewater discharges. Areasonable resolution of the claim was negotiated after arguing all required permits had been obtained and the facility’s production of wastewater did not require additional permitting.
  • Defended an industrial facility in its dealings with a State Environmental Agency and the EPA in regards to alleged violations of its Operating Permit. The case was successfully resolved by establishing the Operating Permit was not violated because any exceedances of the operating parameters were de minimis in nature.
